    I dont know too much about the conflict but the first post on the site says this:
    Immigration Voice is starting a massive campaign to make it easier for immigrants and those on non-immigrant visas (H-1Bs, L-1s, F-4 students) to get green cards --- furthering the displacement of skilled American workers (programmers, engineers, scientists, etc.)

    So, I'm passing along this suggestion from another group:
    Please read the email below, and I ask you to cut/paste their letter text, and then
    customize it (which is to say reverse engineer it) asking them to CLOSE
    the door, not open it wide. We must act NOW to counteract their
    campaign.

    So thats just somebody's interpretation of letter campaign. Perhaps one of the enthusiasts over here should post something over there differentiating the goals of the letter campaign from illegal immigration along with all the arguments posted here and explain that their interpretation is incorrect.

    Got an email from USCIS stating that there is an change in status... This email showed new status as Card Prodn Ordered...

    This was early evening 22'nd Oct.... Got two emails - one for me and one for my wife... exactly identical email.

    Then later at night (closer to midnite NSC time i think), i received the same two emails for me and my wife again.... not sure why.

    Since then no other emails.... So far, i have only recvd CPO email.... no other emails at all...

    Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?

    USCIS may be using divide and silence tactics. One can already see the impact of EB2 being as good as current. They probably liked what they saw and are setting up to move back EB3 much more. At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.

    But, going back to my original question, what are the legal experts saying? Can any legal entity or any type of action force USCIS to explain what the heck is going on?

    If you get different A#s then definitely there is a possibility of delays in the application.
    I am not sure what happens with namechecks. Need to research further. My guess is you will have double chances of getting stuck in namechecks! This assumption is based on the fact that multiple filers need to undergo fingerprinting and background checks multiple times and thus chances of getting stuck in namechecks must also increase for them.

    Be ready with the following supporting documents. My attorney asked the following:
    1. Personal Details -
    (Travel Plans in the next 3 months, Moving Plans in the next 6 months, Contact Information, Passport and I-94 info, Employment Hisotry - Last 5 years+ Last job ouside US, Residence History - Last 5 years + last residence outside US, LC, I-140, EAD and details, and a few other questions, etc)
    2. Passport copies- all pages, current, all old.
    3. All I-20, I-94, I-797, LC, I-140 copies
    4. Birth Certificates or Birth Affidavits
    5. Marriage Certificate or Marriage Affidavits -
    6. Sealed Medical Exam Cover - I-693
    7. 6 photos for adults ( 4 if under 14)
    8. Photocopy of current I-94
    9. Divorce Certificate (if applicable)

    With the June visa bulletin, my priority date became current. My Labor and 140 already approved. When can I apply for I485? After May 31 or before May 31.

    Dear dreamworld,
    First of all thanks a lot for your reply and i further have some question if you could please help me understand that. the situations is that I have given my New I140 (EB2) to my lawyer and all he did was took a copy of my I485 receipt notice and said he will send that to USCIS. My PD on EB3 is Feb. 2003, how would I come to know if my EB3 PD was ported to EB2 by that I mean to how I would come to know if my I485 was ported to EB2 and still have PD of Feb 2003...

    I am not aware of anything that says that you need to bring this up initially in your job search. I personally wouldn't put it in my CV.
    Apply for a job, as you would if you had a green card (keeping within the AC21 parameters.) If the question of visa sponsorship comes up then you can say you do not need it. I am not sure why people bring this up with their prospective employers. If you have employment authorisation, you have it, it is not employer specific, it is not site specific, it is quite broad in its scope. The employer
    has to complete the I-9 like for anyone else. Any issues would be with the USCIS at the time of adjudication and that would be if AC21 rules are broken.

    I think that sometimes we project our own fears onto employers and make issues when none exist. I've seen the same sort of doubts expressed about AP travel.
    Folks need to grow more confident generally. For many their immigrant petitions 140s have been approved and their 485s have been pending for quite a while. They give you these interim benefits for a reason, so you can use them!

    Not sure if you are in the IT field, but a reqruiter/HR is the first interfacing person. No matter what, these are the first questions you can expect when a reqruiter calls you.

    dice.com, monster.com etc... wants you to select from a dropdown what your status is and in most cases, employers/reqruiters filter reesumes based on that criteria.

    I just received my 2 year EAD. Priority date is Nov 2002 - EB3 -India. Well I guess that says it all. If USCIS thinks that Nov 2002 will take at least another 2 years then I dunno what about the rest. I didn't wanna think about EB2 porting being so close and spend another 10k, I guess just need to stop worrying about it now. :)

    Hi

    I have a approved i140 with priority date of Dec 2004 EB2. My spouse has approved i140 with priority date Mar 2006 EB2.

    Since it is not recomended to apply 2-1485's we decided to settle on mine. But then, since we both have our H1's for next 3 years, we don't want to use EAD and AP till the final process of GC is done.

    My question is should we apply for EAD and AP or not. This question exists in the questionaire given by my employer.

    Please advice.

    Today at 9:03 PM I got the following magic letter

    On September 9, 2010, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    Came to US in 1999

    Applied for EB3 labor in July 2004
    Applied 485 in July 2nd 2007
    Waiting for EB3 dates for India

    Mean time wife applied for EB2 NIW Self petition in March 2006 and got approved
    Again she applied for new labor in Nov 2009 and applied for I-140 in May 2010 in EB2
    Her new EB2 I-140 got approved in Aug 4th 2010 and USCIS ported the March 2006 priority date automatically

    Yesterday she opened SR and today got the approval magic letter

    Please dont use google it is a waste of time - FBI uses its own databases and looks for 'hits' in terms of derogatory information.

    Instead lobby for the following:-

    1) USCIS should have the authority to ask FBI as to why the namecheck is taking so long and provision to expediate name check if it is has been pending for more than 'x' number of years (probably 2 or 3 i guess).

    2) FBI should provide a reason for the delay. Most of the time (80%) the delay is simply because they dont have the time to open your file.

    3) Procedure to Pay $500-$1000 to expediate NC (1 week) with a yes or No result. this will all allow FBI to obtain resources to process NCs faster

    NC is the next bottle neck that we have to lobby for.



    If I search my "Firstname Middlename" there are 10000 hits in google :-). And I know for sure there are few murderers , politicians and movie stars(most of them are arrested atleast once for crime or the other :-)) who have the same first name and middle name as mine back in India.Last name is what makes the full name unique.

    My Namecheck was initiated Aug 4th as per TSC IO and is still pending.Looks like I am going to be waiting for a long time.
