No I don't. You basically don't want to keep the door open wide. Once you are IN you want the door to be closed. You don't worry about loosing US jobs to India/China, but you don't want Indians/Chinese to enter USA and enjoy the "quality of life" you enjoy here.

You are getting dangerously accustomed to the "taking things for granted" style. You are loosing your competitive skills.
I personally know that more energetic people coming in is kind of dangerous even for my job safety-net (basically I cannot take things for granted). But I still have not learned to think beyond humanity, and I believe sharing is good. The new guys also deserve the chance for American dream.
And I don't forget that I was also once in H1B, and came with a lot of dreams and skills.
However, my point is, if you want to outsource take the job to the low wage country. Do not bring low wages here. I am ok if outsourcing would increase because of the Grassley bill. I am not ok if the low wages are dumped in here. I hope you people see the difference.

Being stuck in the EB3 conundrum, I usually find it hard to bring myself around to feeling good about the turn of fortune for folks in other categories. Yesterday was a very eventful day for me...in the afternoon my wife got approved and 12 hours later we had to call in emergency 911 to take her to the hospital as she was having such strong chills and violent shakings..we all got scared and we have a 2 and half month baby on top of that.....but with strong dose of antibiotics and drips she is better and back.....wow what a day and night.....
In any case I'll answer all your queries....I feel the option 4 is the best way to get to TSC...I have always used that....congressman's office has discretionary powers and you should use that.....use strong words it is your right......they are here to serve you unlike in India where they are there to get pocket your money....no pun for my motherland but unfortunately it is true....
Try a time frame of 4:30-5:30 EST to call the TSC or NSC for that matter...ppl are in a better mood at the end of the day and on thursdays and fridays.....ping your lawyer and ask him or her to intervene......if you know for sure your case is preadjudicated write it strongly in your mails to DHS and others.

I have prepared all the documents for I-485 for my self and my wife. I have got copies of all the imaginable papers that needs to be included.
I am also going to file I-765 for EAD for my self. My question is that I will include this form with my application along with the necessary fees. What about the supporting documents for I-765 -- like last I-94, passport pages copies etc -- (which are already with I-485 application) needs to be attached 2nd time or no.
Please advise.

Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

Hello,
I'm on H1B and eligible to file I-485 (PD Apr'04 , I-140 approved) and my son was living with us (me and my wife). He joined undergraduate course in Canada in Sep'2006. He visits us frequently and he is 19 + years old and got Canadian PR. I asked my attorney whether I should file I-824 form to transfer his case to Montreal, Canada? But attorney suggested to file for AOS since he will age out once retrogression starts again. All three of us have I-94 dated Jul'06 when we came from India and does not require to get new I-94 since he visits us frequently driving through Buffalo,NY. Now my question is related to form g-325a:\
1. What should he write in applicant's residence in last five years? Should he indicate that he is not living in US or living with us?
2. What should he write in applicant's employment history? Should he write school/college name?

thank you for your info on calling uscis and requesting namecheck info.... i called them today, asked about FP 1 and if it had been sent out... they told me to wait for FP notice but they were able to check for name check info..... name check has passed..... 485 RD July 16 2007... thanks again for uscis contact info

I recommend both husband wife file for yourselves and for each other. So between the two , there will be four 485 applications. One: Wife as primary, husband as derivative. Second, husband as primary and wife as derivative. We do this all the time and this is the safest thing to do. You will keep whichever 485 set gets approved, first, the other will be rejected by CIS.

for once sepia mutiny decided to cover our story. i still dont understand that blog. more than 80% of the posts are dedicated to ridiculing indian issues...most of the contributors are indian americans...but they never cover our issues.
i cant understand why they cant make up their mind...either limit yourself to covering indian american issues or accept that we are a part of your ethnic group too. is there an african american blog that keeps harping about child mortality in africa? is there a italian american blog that is dedicated to researching origins of pasta recipes in italy?
i dont get them but at least we get some more coverage.
because most of them are ABCD's or people who got their GC's in late 80's & 90's and are citizens now. Most of the regulars there might not know the whole GC mess, except for a bunch us who flocked with the GC post.

You are absolutely right. We visit Mr Oh's website several times a day to get the latest on immigration. We should credit him for being the first in alerting us about everything. If in fact USCIS comes up with a statement rejecting all aplpications filed after a certain date, I'm sure there would be thousands who would be saved by Mr. Oh's timely warning.
I dont know why everybody started to spit on ohio law firm. They just pointed out some news that they got from AILA, right? Lets hope its just a rumor and USCIS doesn't proceed with this revised thing. I am pretty sure that wont happen. Dont worry guys, but dont blame everything on ohio firm. I saw this on several other law firms too.

Good news... I got CPO at 9:05AM.
I raised SR for my case on 9/2 and no response until today morning and raised SR for my wife yesterday night. No changes to my wife application.
I asked my attorney sending an e-mail for TSC streamline process and I do not know whether he acted on it or not.

I am a July 2nd files, they told me to call on the 3rd of October. (I don't know what is the logic to calculate 90 days at the USCIS). I am trying to make the attorney call that day. May be she will have more luck. :confused:

I have a feeling that the IO might look at the applications received on Aug 17, 2007, only at last. Its because, when I went for infopass, the IO said that, "You have filed on the last date, so you will have to wait".
Anyhow, I have tried all that I could, and now I leave it to the Almighty.

Yes, it was based on the State you lived. One other thing, you may want to check with Customer Service, since when are you have been actually considered a PR. If they have considered you as a PR since 2008, it is good for you, you will be able to apply for Citizenship sooner

50% rule applicable only to an organization which has more than 50 employees.
Since most of the consulting companies employees strength is less than 50 ( I believe) the rule of 50% rule will not be applicable and they can file application till they reach 50.
